Terms of Use
1. Purpose
This document is intended to govern the relationship between a User and Oliv Tasting Room arising from the use of Oliv's online shop.
2. Definitions
“Agreement” means this document
“Oliv” means Oliv Tasting Room
“Personal Information” means personal information as defined by section 24 of The Freedom of Information and Protection of Privacy Act, SS 1990-91, c F-22.01, as amended.
“Product Portal” means the website developed by Oliv designed to facilitate the purchase of olive oil, balsamic vinegar, and related products
“Server” means any computer system, or series of computer systems, designed to permit the remote storage and retrieval of data
“Site” means the Online Shop
“User” means an individual accessing the Online Shop
3. User Accounts
i. To purchase products from the Site, Users will be required to set up an account.
ii. In setting up an account, Users are required to provide Oliv with certain pieces of Personal Information, including but not necessarily limited to, their name, address, and telephone number. This information is collected in accordance with Section 25 of The Freedom of Information and Protection of Privacy Act for the sole purpose of facilitating the sale and shipping of olive oils, balsamic vinegars, and related products.
iii. Users are responsible for ensuring that the information they provide is accurate.
iv. Users are also required to create a unique user id and password. Users are responsible for the security of their ids and password.
v. The Online Shop is provided for purposes of convenience only. Users have no right to an account. Oliv reserves the right to deny an account to any User, for any reason, at its sole discretion. Permission to create an account can be arbitrarily withheld.
vi. Oliv reserves the right to delete, modify, or terminate an account at any time and for any reason, at its sole discretion.
4. Information Management
i. All information provided to Oliv (with the exception of the information listed in clause iii below), will be held solely by Oliv.
ii. All information is handled in accordance with the terms of the Online Shop’s privacy statement, the terms of which are hereby incorporated by reference.
iii. Processing of fees associated with purchases made through Oliv’s Online Shop is done by Paypal. To process payment, the following information is sent to Paypal.
a. Transaction ID
b. User Detail
c. Amount
This information is sent solely to allow for payment processing. All processing is done by PayPal and your use of the service is subject to PayPal’s Terms of Use. Oliv accepts no liability for any loss or damage suffered as a result of the use of PayPal’s payment processing module.
5. Oliv’s Release of Liability
i. Oliv makes no warranties, express or implied, as to the fitness of the Site for any particular purpose, nor does it warrant that it will function uninterrupted or error free.
ii. Oliv is not liable for any errors, omissions, or inaccuracies in information supplied to Oliv by Users of the Online Shop.
iii. Oliv is not liable for any loss or damage to business, profits, opportunities, computer hardware or software caused by the Site, or any malfunction or error associated with the Site or its use. All risk occasioned by accessing the Site as well as the creation and use of an account lies with the User.
iv. Creation of an account or processing of a payment is not a guarantee that products will be sold. Oliv reserves the right to refuse any sale for any reason and at its sole discretion Monies related to a cancelled transaction will be refunded in full.
v. Oliv accepts no liability for any unauthorized use of the Site caused by the User’s failure to safeguard their id and password. Oliv cannot, and does not, take any steps to verify the identity of Users beyond the authentication provided by the User created id and password combination.
vi. Any refunds will be issued at the sole discretion of Oliv.
6. Governing Law
i. This agreement shall be governed and construed in accordance with the laws of the Province of Saskatchewan. All parties agree to submit to the exclusive jurisdiction and venue of the courts of Saskatchewan to enforce any provision, or settle any action or suit arising out of this Agreement.
7. Severability
i. Each of the provisions contained in this Agreement is distinct and severable. A declaration of invalidity or unenforceability of any one provision or part thereof by a court of competent jurisdiction will not affect the validity or enforceability of any other provision in this Agreement.
8. Entire Agreement
i. This Agreement represents the entire Agreement between the parties.
9. Notice
i. Any notice given under this Agreement, will be sent by regular mail or email . If there is a postal disruption, notices will be either faxed or hand delivered.
